at least she won't win the lawsuit. at least she wouldn't if she lived in philly. Heard of a guy once who fell through a sidewalk grate because it wasn't secured correctly (and not just for a few seconds while the guys were getting cones) and he actually broke something (ankle I think). didn't win anything from the city. this girl wasn't even injured. scrapes and bruises? c'mon. watch where you're texting.
LOL, I watched my brother do the same exact thing when we were in high school. But at least he had the excuse that it was getting dark and he didn't see the open manhole. One second he was there, next he was gone! Of course, my Dad just laughed, no suing involved. Maybe instead of suing, that stupid *** mother should smack her daughter for texting too much.
That's one of the problems with America. We allow frivolous law suites. That's why we don't make the flu vaccine here anymore.
It looks like I'm in the minority, but I agree with the girl. First, she's a freakin' girl. How many do you know that age who don't do things like walk and text at the same time? Also, how often have you seen open manholes without someone working inside or coned off? I don't think that a lawsuit is necessary, but I think that the city is at fault.

I dunno its easier than you'd think. I busted my *** taking out the trash because I forgot we have a step on our porch....and I've lived in this house about 3 years now.
lol really, I walk back to my apt after getting the mail, reading it and no troubles, steps and all. maybe my Peripheral Vision is strong. Also, walking through the gym or on the beach with me mp3 player changing songs while looking at it and reading the titles no problem. That might be something to look into bro.

Well I mean I only did it once I have good vision too, but I can just see where someone could make a mistake and make a fool of themself once. That doesnt mean I think she should sue and win a bunch of money, but maybe a small settlement. Afterall the cones werent up yet, theres a reason those cones go up and its to prevent this.
OK, here's a fundamental question: WTF was she doing walking on the street? Because they don't put manholes on sidewalks. nor do they ever put them in crosswalks. So - again - WTF is anyone, let alone someone that stupid, doing walking in the street? Good luck getting a jury to buy into this one.
Actually, you're wrong on this one. When my brother fell through the manhole at night, it was a manhole in the sidewalk. They also have manholes in yards instead of streets. (See my front yard for example).
