While I agree with all of that, the burden of proof is on the prosecutors, no? They would have to prove (or establish a motive / show intent) he shattered his phone and cctv systems. Who's to say the phone didn't fall in the street and got run over by a car? IMO he's probably guilty of something beyond just obstruction and it makes sense to keep the charge at just OoJ for a while, but we just have to hope the prosecution are wise enough to not let anything crucial slip between the cracks.
Yeah, the burden of proof is on the authorities, but what plausible explanation could he possibly gave for two pieces of electronics that were subpoenas showing up in pieces? Not saying they have concrete anything, but I'm assuming he didn't smash his phone prior to the incident. Also, there's a good chance that the surveillance system was in one piece when they first visited the house, or that it stored information off site. If he has a plausible explanation as to why his cell phone and video surveillance system that were requested by police were both discovered smashed shortly after a friend/acquaintance of his was found murdered near his home near a rental car the morning the two were seen together, then he'll get his chance to tell it to a jury and they'll let him off. Oh, and the house cleaning...

Just because the police are checking the lake does not mean the gun is there. They may be searching it just to cover their bases because they would look stoopid if it was in there and they never bothered to look.

Kind of a dick move by the cops. Usually when you have a suspect whom you've had constant contact with (and his attorney) you call up his lawyer and ask him to turn himself in.
He exactly hasn't been cooperating with the police, like destroying evidence, I can see why they don't want to do him any favors.
