At the same time its possible he was cheating and his wife found the receipt then tried to headbutt him and hurt herself. I wouldn't throw the guy under the bus with out all the facts.

most likely, as that's what we have in Cali. There has to be evidence of some sort of physical violence. it can be incredibly minimal, like a light bruise or a minor fingernail scratch, but it counts. A strictly verbal argument however is a no go usually.
Perhaps I mis-wrote, but I thought domestic violence meant there was signs of injury, and arguments fell merely under domestic disturbance.

no you are completely right bud. I should have made that distinction as well. The difficult thing is that when responding to those types of calls its often unclear exactly what it will fall under until officers investigate.. that is unless you get firsthand information from the victim stating they were injured, or a witness who sees the violence. More often than not though these calls come in from neighbors who can only hear the noise and don't know if its violence or just a disturbance
From my understanding... and annulment can only happen within the first 6 months... after that it's a divorce. This is in my state. Other states may be different. In an annulment there is no division of estate, belongings, etc. Everyone walks away with what they had going into the marriage and there is no spousal support issued, etc.
interesting. I mean, that's a great clause to have for everyone's sake, because it leaves some room for the good kind of discretion. (not the "i'm gonna blow this one off" kind) but more if it's entirely obvious that there is an abuser but no physical injury it allows the officer to pluck that person out of the house for the night.

If this turns out to be an injury from them struggling over the condom receipt (ridiculous to even say) as opposed to him deciding to strike her, or if it turns out she did some whacky crap she did that caused her to end up hitting her head (like she grabbed the steering wheel or some **** when he tried to start moving the car... who knows).... then is there a chance this guy can get cleared, and move on? Marriages only a few months in can get annulled, you know. .... of course if he got mad and hit her intentionally, then he pays the legal price and rightly so. No excuse for taking out your anger physically on ANYONE, woman, man or beast.
An annulment is like you never were married . Easier to get if it was never consumated. It is like the marriage never occurred , I know it is associated with the Roman Catholic religion mostly ( I believe ) .
