    Well it happened at the beginning of the month.
    You have proof he wasn't driving and was out of state or are you speculating that he didn't do it just like people did with Ronnie when he was driving drunk.

    that's not what he said. He said running away from the vehicle where no one was hurt and answering questions later on will probably get him in less trouble than drunk driving. I wouldn't have done it that way, I would have stayed there, but me is stupid.

    I understand that but my whole point is if hartline was out drinking and driving that is a stupid move and he should have been smarter than that if indeed that were the case. Not saying he was but when someone abandons their car after a wreck it is a safe bet he was drinking. Was it smart to leave the scene and avoid a dui. yeah I guess but he should have never been in that situation. thus the hartline should be smarter than this comment. :wink2:

    Ken LaVicka looked on his twitter and his tweets suggest he was in California as late as June 29th and going to Ohio on July 6th. No idea where he spent the 4th of July weekend.

    Either way, this is barely even a blip on the radar. I've not been one to underplay the Dolphins' troubles this off season in fact I think I've said that nearly all of the atricles written about them (with some exceptions) have been fully deserved. But this won't result in an arrest, it won't result in league or team action, and I don't see how everyone just blanket assumes that there had to be drunk driving involved.

    This doesn't even rate up there with the Ronnie Brown or Will Allen DUIs, let alone the domestic violence issues of Tony McDaniel or Phil Merling, or Jeff Ireland's asking Dez Bryant if his mom is a whore.

    I read the article.

    Nobody has been cited. They're still investigating. They don't know who was driving, etc.

    So he's not "in trouble". At least not yet.

    Not saying it is the case because I don't know the whole story but when someone leaves their vehicle at the scene of a crash I would say it is a safe assumption that they were driving drunk. I would bet the police would assume that as well. Very hard to prove but easy to speculate.

    I think If this was hartline, i.e. he can't prove he was out of the state at the time or some other evidence, it may be worse. Those other two involved single car accidents. This involves a parked car. So it's a hit and run (literally). Anyone familiar with this Interstate? How is it that there is another parked abandoned car on it? I know interstates vary from state to state but is it common to have cars on the side of the road?

    I've driven in Texas Louisiana etc. where Interstates are like regular roads. out here in Southern CA they're all walled off or completely inaccessible to regular areas for the most part.

    A $500 fine. That's about it. I know it's POSSIBLE for him to get 60 days of jail but I seriously doubt that would come even close to happening.

    Not to mention it sounds to me like there's an obvious gray area in how much time you have after the accident to make a good faith effort to notify the authorities about the accident. It could very well be the police found the car before that amount of time expired. And there also looks like some gray area about what constitutes a good faith effort to notify the owner of the unattended vehicle about your information. The fact that his truck was still there may show that he was not intending to damage the unattended vehicle and then never make recompense for it. The owner of the unattended vehicle could come back, notice his vehicle damaged, see the abandoned truck with matching damage, and take down the license plate info. I think Hartline could show that he wasn't trying to get away with not making proper restitution.

    That leaves the question of whether or not the authorities gave Hartline enough time to report the incident...a gray area which could result in him having to pay that $500 fine, or having the whole thing dropped.

    I almost wish that he was plastered and ran away because I'm always hearing about how smart he is. I'd be interested to know if he could get away with it. I look forward to your letters...

    And that's even if they can mount enough evidence to charge him by showing that he didn't make a good faith effort to find the owner of the vehicle, leave his information, and to notify the authorities.

    What time did the accident happen? The police found the vehicle and called his wife at 4:30am. Did the accident happen at 4am? 3am? How much time is enough time to say that Hartline was no longer able demonstrating good faith in an attempt to notify the authorities about the accident?

    These are the reasons why they likely haven't charged him.

    I think people are getting ahead of themselves. We don't know what happened that night and odds are no one will. To say it is a safe assumption they were driving drunk is a bit ridiculous, How is that a safe assumption? There is a laundry list things that could of happened yet everyone jumps to DUI. This case has one fact, Brian's car was found abandoned coiled with another abandoned car. Was there alcohol or controlled substances in there, I did not read that. The burden of truth is on the is on the prosecution and they have little to work with. The car could have been stolen, a friend of his could have been texting while he or she was driving and crash. They could have been eating popcorn earlier and their hands were really slippery from the butter. It's all one big question mark, and most likely Brian will just pay a small fine, if that.
