If the "only difference" between it being molestation or rape is the thin layer of clothing, then you are essentially saying that Cog's intention was to penetrate her. If his intention was not to penetrate, then it's not almost rape, it could be felonious sexual assault, or even perhaps aggravated felonious sexual assault. Although many states you could plead down to simple assault in a case like this.
If somebody molests my daughter, it's damn well close enough to rape for the perpetrator to be really worried about being anywhere near me... For once, I agree with Fin D... O.o I think the main point in this is: the reason it doesn't matter what the victim's response in this situation is that if he's done it once, he'll likely do it again. The next victim may not be so "nice" and Richie should be far from this team if/when it happens.

You're not understanding. I said it was borderline rape. Not the same thing as rape. Not exactly as bad as rape. Its close to rape. The reason its so close to rape is because the only difference between it and rape is penetration and victims of rape and molestation often suffer from many of the same issues afterwards. Molestation and rape are both violations of the person. Is rape worse? Yes, but so what? The notion that molesttation is simply not that big of a deal and saying it is a big deal somehow lessens the severity of rape is frankly.....****ing stupid (I'm not saying that you are implying that btw). Further some states do in fact consider what he did sexual battery. Granted, the state it happened in (FL) does not, but some do.
I guess it depends and maybe I don't know technically what the definition of molestation is, but rape is a whole other ball game.
Try talking to victims of both. Rape is worse, no one said otherwise. But molestation is not THAT far off.
